Section 01

Privacy Policy

Effective Date: January 1, 2026

Data Controller: buildwavedev, Carrer de Sant Vicent Màrtir 45, València, Ciutat Vella, España.

1. Data Collection & Purpose

buildwavedev collects personal data solely for the purpose of executing requested services and maintaining communication channels. The following data categories may be processed:

  • Full name and email address — collected via the contact form for service inquiry processing.
  • Phone number — provided voluntarily for direct technical communication.
  • Project specifications and technical requirements — submitted voluntarily during the service engagement.
  • Payment information — processed exclusively through Stripe's PCI-DSS compliant infrastructure. buildwavedev does not store raw payment data.

2. Legal Basis for Processing

Data processing is conducted under Article 6(1)(b) of the EU General Data Protection Regulation (GDPR), as processing is necessary for the performance of a contract to which the data subject is party, or in order to take steps at the request of the data subject prior to entering into a contract.

3. Data Retention

Personal data is retained for the duration necessary to fulfill the contracted services, plus a maximum period of 24 months for administrative and legal compliance purposes. Upon expiration, all personal data is permanently deleted from active systems and backups.

4. Data Sharing & Third Parties

buildwavedev does not sell, trade, or rent personal data to third parties. Data may be shared with the following service providers strictly for operational purposes:

  • Stripe, Inc. — for payment processing. Subject to Stripe's Privacy Policy.
  • Email service providers — for transactional communication. Data is encrypted in transit.
  • Cloud hosting providers — for infrastructure operations. Data is stored within the European Economic Area (EEA).

5. Data Subject Rights

Under the GDPR, you have the following rights:

  • Right of access (Article 15) — Request a copy of all personal data held.
  • Right to rectification (Article 16) — Correct inaccurate personal data.
  • Right to erasure (Article 17) — Request deletion of personal data ("right to be forgotten").
  • Right to restrict processing (Article 18) — Limit the processing of personal data.
  • Right to data portability (Article 20) — Receive personal data in a structured, machine-readable format.
  • Right to object (Article 21) — Object to the processing of personal data based on legitimate interests.

6. International Data Transfers

All personal data is processed within the European Economic Area (EEA). In the event that data transfer outside the EEA becomes necessary, buildwavedev ensures appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) as approved by the European Commission.

7. Data Security

buildwvedev implements appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption of data in transit (TLS 1.3), access controls, regular security audits, and incident response procedures.

8. Supervisory Authority

You have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos — AEPD) if you believe your data protection rights have been infringed.

Cookies Policy

1. What Are Cookies

Cookies are small text files placed on your device when you visit a website. They are widely used to make websites work efficiently and to provide information to website owners.

2. Cookies Used by buildwavedev

buildwavedev uses strictly necessary cookies only. No tracking, analytics, or advertising cookies are deployed. The following cookies are in operation:

  • bw_cookie_accepted — Type: LocalStorage. Purpose: Stores the user's cookie consent preference. Retention: Until manually cleared or browser cache is purged. This is essential for the site's compliance mechanism.

3. Third-Party Cookies

buildwavedev does not use any third-party cookies. External resources (such as the Google Maps embed on the contact page) may set their own cookies in accordance with their respective privacy policies. buildwavedev has no control over these cookies.

4. Managing Cookies

Section 03

Refund Policy

Effective Date: January 1, 2026

1. General Refund Terms

buildwavedev operates a milestone-based payment structure. Refunds are evaluated based on the completion status of project milestones at the time of the refund request.

2. Pre-Project Cancellation

If a project is cancelled before any work has commenced (within 48 hours of initial payment), a full refund will be issued minus a 5% administrative processing fee.

3. Mid-Project Cancellation

If a project is cancelled after work has commenced:

  • Milestones completed and approved: No refund. Payment for completed work is retained.
  • Milestones in progress: A pro-rata refund may be issued based on the percentage of work completed at the discretion of buildwavedev.
  • Milestones not yet started: Full refund for unstarted milestones.

4. Post-Delivery Disputes

If a delivered project does not meet the specifications agreed upon in the initial project brief, buildwavedev will, at its discretion, either remediate the identified issues at no additional cost or issue a partial refund proportional to the deviation from specifications.

5. Refund Processing

All approved refunds are processed within 14 business days to the original payment method. Refund requests must be submitted in writing to [email protected], referencing the project name and invoice number.

6. Non-Refundable Items

The following are non-refundable: domain registration fees, third-party license costs already procured on behalf of the client, and administrative fees for scope changes approved by the client after milestone completion.

Section 04

Terms of Service

Effective Date: January 1, 2026

1. Service Agreement

By engaging the services of buildwavedev, the client ("Client") agrees to the following terms and conditions. All services are provided on a project basis as defined in the individual project brief and scope document.

2. Scope of Work

The scope of work for each project is defined in the project brief signed by both parties. Any deviations from the agreed scope constitute a scope change and may result in additional charges. buildwavedev will notify the Client of any anticipated scope changes before proceeding.

3. Payment Terms

Payment is structured in milestones as defined in the project brief. Invoices are issued upon milestone completion and are payable within 14 calendar days. Late payments accrue a 1.5% monthly interest rate. buildwavedev reserves the right to suspend work on any project with an overdue invoice exceeding 30 days.

4. Intellectual Property

Upon full payment, all intellectual property rights for the delivered work are transferred to the Client. This includes all source code, design assets, and documentation created specifically for the project. Pre-existing frameworks, libraries, and tools used during development remain the property of their respective owners and are licensed to the Client under their original open-source or commercial terms.

5. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information exchanged during the course of the engagement. This obligation survives the termination of the service agreement for a period of 36 months.

6. Limitation of Liability

buildwavedev's total liability under any engagement shall not exceed the total fees paid by the Client for the specific project giving rise to the claim. buildwavedev shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities.

7. Warranty & Support

buildwavedev provides a 90-day post-delivery warranty covering defects in the delivered work that were present at the time of handover. After the warranty period, ongoing support and maintenance are available under a separate service agreement.

8. Termination

Either party may terminate the service agreement with 14 days written notice. Upon termination, the Client is responsible for payment of all work completed up to the date of termination. buildwavedev will deliver all completed work and source code within 7 business days of termination.

9. Governing Law & Dispute Resolution

These terms are governed by the laws of the Kingdom of Spain. Any disputes arising from the service agreement shall first be subject to good-faith mediation. If mediation fails, disputes shall be resolved before the competent courts of València, España.
